What Is a Christmas Shutdown — and Why Do Businesses Have Them?

Can You Require Employees to Take Annual Leave?

In many cases, yes. But it’s not always a given. Some awards or enterprise agreements let you direct staff to take annual leave during a shutdown, while others don’t.

You’ll need to:

  • Check the relevant award or agreement for shutdown rules and notice periods
  • Provide written notice (usually at least 4 weeks before the shutdown)
  • Confirm the employee has enough accrued leave

If someone’s leave balance is short, you have two options:

  • The employee takes unpaid leave (with their written agreement), or
  • An advance on annual leave is provided (again, by mutual agreement)

If there’s no award or agreement, you can usually ask staff to take annual leave, provided it’s a reasonable request.

What Are Employees Entitled to During a Christmas Shutdown?

If an employee is on approved annual leave during the shutdown, they’ll continue to receive their usual pay.

When a public holiday like Christmas Day or Boxing Day falls during the shutdown, you should pay it as a public holiday, not annual leave. If staff work on a public holiday, check if penalty rates apply under their award.

You still need to issue payslips, report through STP, and meet payroll obligations — even when the business is closed. If you manage payroll in-house, that means ensuring everything’s scheduled in advance. If you use outsourced payroll services, your provider can keep things running while you switch off.
